Look around a little bit for the count() function. You can use this to see how many instances of a repeating group are present in the XML. If it is equal to zero, then you will need to fire your data validation.

The problem arises for every form which was digitally signed whether it is done in VS.NET 2003 or not. As you stated the problem could be with the digital signature. I forgot that with a digital signature you don't have to install the form to your machine - I have never done Full Trust with a digital signature before, oops! So my guess now is that the digital signature got some how corrupted. I would redo the whole signing process if you can.
