Image illustrating the difference observed between the two views attached.  This was generated with a preview, but the exact same behaviour is observed in a published form.

Also using IP2010 I set up a simple example.  Use the button to swap between a view with the rich text field read/write and the rich text field marked read/only. As soon as you use shift-return on any form of list (bulleted, numbered, etc) to add extra spaces between lines the behaviour is evident. 

I can publish it, but when I go to Submit it, I get another error. "Infopath cannot submit the form"  Details: InfoPath cannot submit the form. The form was not submitted because a form named Form.xml already exists in the document library at [URL]. Please contact the provider of the form.
