Hi Crhis and welcome!
Have you checked the Design Checker in InfoPath Designer for warnings or errors? If not, that might have something in it.
The best way to diagnose the issue is to look at your SharePoint logs. They will give you a specific error of why the publish is failing.
This should be pretty easy to figure out. We have ...

Hi Bejeweled,
You can do one of the following:Query your SharePoint list with a filter (qRules FilterOwssvr, SharePoint 2010 REST, or DBXL QuerySharePoint are three ways to do this)
This technique is best practice for large lists since the filter is done on the server. Get all items from SharePoint list and filter in the form

Hi Jen,
This is really weird.
The error message suggests that the InfoPath process running locally is opening the file twice for some reason (or is doing something that prevents all future files from opening, for example, by locking a resource).

Hi legolas,
I would suggest creating a Form Name field and adding a rule in your submit button that sets the Form Name field to the value of the Surname field and run the rule with a condition only when the Surname field is blank. Then, in your submit data connection, use the Form Name field as the Filename.
Let me know if that helps.

Hi Hilary, thanks again for your help. We didn't end up see anything strange in the log files. When I removed a good handful of those picture buttons everything seem to go back to normal with publishing. But then after a couple views new views, I was right back to that same error message. So I deleted more picture buttons , and then it ...
