Check if an inforpath form exist on SharePoint site

I have defined a form for submit to a sharepoint site. There might be more than one person open a form. The first person who save the form might be overwritten by others. Therefore, I tried to set the submit as a data connection to save the form without overwriting. However that may cause an exception when the form already exists (first person saved the form). I think I have to add a rule to check if the form exists on the sharepoint site or not. Is there any way to do that?

By the way, I am using InfoPath 2003.

You can setup a receive data connection to the library and then do a check to see if the filename exists or not before your save action runs.
