I guess the first thing I'd wonder is if there were rules on load, or default values, that are changed when the XML file is opened. So, I wonder if the "email" portion is just a bit of a red herring - that is, if you fill out the form and save the XML locally, and re-open the XML, do you get the same error?

Converted your XSN to XML? I don't think that button does that.... Want to attach your form under the options tab?

Hi - what is the data source for the drop down list? Does the drop down use a secondary data source for it's values? Or have they been manually entered into the control?

Usually, I see this issue if for some reason the Qdabra Rules data source has been manually walked through in the form and then the form has been re-injected. In your view, you could add the "Edit" column - I realize that isn't precisely what you are looking for, but it would give a one-click option to open the item in edit mode.

So, is the above XPath getting you the correct count of all rows? If so, you can just add a filter: count(../../my:repeatingGroup/my:repeatingTable/my:uomRepeatingTable[my:ColumName = 'Smith']) But instead of ColumnName above, you'd use the actual name of the field that would contain "Smith".

Hi: With regular InfoPath forms you may be able to do this by using a form web part - here's a blog post that may help you. To my knowledge, this is not possible with SharePoint List forms without jquery or some other code based work around.
