Well, the issue is, as you mention, we can't update a secondary data source in the form, only the main data source. I'm not really understanding why you don't want to save the data in the form's main data source.
I (as usual - I'm starting to think I lack imagination) am having a little trouble following exactly what you are ...

Honestly, I'm slow today, because the form you sent works just the way I expected. Where are you having a problem? You originally said:
after submission, it the formatting is not there for the recipient
Can you show a screenshot or something of what isn't working the way you expect?

Okay, so if I fill out your form today, and save the file, any date that is 8/1 will be highlighted red - today.
But if I open the saved file tomorrow, any date that is 8/2 would be highlighted red. Is that what you want?

Well - actually, the default behavior of a rule set on a control / field outside of a repeating group would be to act on all instances of the repeating field. So if you put a button someplace on your form (just to test) and set it to set the status to blank in your repeating group, clicking that button should clear all instances. It is a behavior ...

If the values aren't in a secondary data source, there is no way in IP to get the display. Not even in code. Sorry - you'll want to use an XML data source or something for this.

I've not run into this before. Have you tried a web search on your error?

I'm wondering if I'm just having some trouble understanding what you are doing. :-)
So, you have a date picker on your form. And you need conditional formatting based around the date in that control less 2 days? I'm attaching a little sample that does something like this - the logic may not be exactly the same as what you are doing. ...

Your error indicates that in your command you don't have a space between "SetValue" and "/xpath" - although in the command above, you seem to - could you check that first?
I think you may want to use "last()" here as well, since your inserted row is probably going to be the last one, and you'll need a concat ...

Want to upload your form (under the options tab) and I can see if it happens on one of our SharePoint 2007 servers? Then at least you'd know if the issue was consistent....
