Glad you got it worked out. Your solution seems like a pretty good one and I think cloning the attribute is probably as good as any other approach.
Just so you know, you can manually create an xsi:nil attribute like this:

Is there a way to reinstall these commands?
If I still had the customize, I could do a reset.
But I had the Customize command removed.

But, as you state the IRM only seems to limit users from copying, printing Saving and SaveAs. And the cost seems to be prohibitive.
I experimetned with the "Enable Protection" along with Tools/Customise menu commands.

Also, there is conditional formatting on all of the optional sections for each step. Based upon how wierd the form is behaving, I guess I can't rule any of those out as well?
