Referring back to just the library submit and the two copies, did you also change your logic for creating the form name? As long as you have a formula including username and now as part of the form name, the form name will change every time you submit. Use a form field for the form name and set the value only one time instead.

Oh. I see why your form submits twice. Because you have it submitting twice in the rules. In your library submit connection you have "allow overwrite if file exists" deselected - you'll want that selected. Your form name uses "now()" in it, so it is going to change every submit. I generally add a field to the form for ...

You may also want to try just setting the title to start with - so modify your Add List Item test XML file to only have the title field, don't attempt any updates, but see if you can get your submit to the lists web service to just add a new item with the title populated.... Is the listItemID field being populated, currently? That is, are you failing when you try to add ...

Can I see your form? You can attach it under Options in a reply. Most recently when I saw "cannot access a closed stream" using the Lists.asmx web service it was because a field was being submitted twice to a list (http://www.infopathdev.com/forums/p/30102/102862.aspx)

Did you try changing the count piece of the formula to my suggestion?
count(preceding-sibling::my:mlstSubCategory)
I changed your formula to:
xdMath:Eval(xdMath:Eval(my:TDEInfo/my:SubCategories/my:mlstSubCategory[. != ""], 'concat("<", count(preceding-sibling::my:mlstSubCategory) + 1, ...

You can attach your form to a reply under the options tab if you'd like me to take a look. :)
