It seems to me like the submit data connection is not the root of the problem. The mapping.xml will also (slightly) change, even if your list has all the same columns in the new site. The reason is that the mapping.xml uses the Sharepoint internal GUID for the list, and this GUID will be different in the new site.

If the FileName is unique (I assume it must be) couldn't the form use that to query the library and find the newly created item?

Usually when you publish via InfoPath 2010, there is an option to update the data connections to point to the new server. Have you tried this?

The command's default functionality is that it will return the filename and URL to the corresponding attributes (see Appendix C of the User Guide).
Perhaps I'm misunderstanding the question, but this provides you the file's URL, so you can reference it as needed. Does this work for you?

The form settings for Save/Save As are determined by the form itself. You'll need to enable Save/Save As and then open the form in the client. Then you'll be able to save down a blank XML.

(a) using something like Active Directory where you can detect which group the user belongs to

Yes, there is a way to have the attribute on more than one field. In InfoPath you'll need to right click the field (qRulesFilename for example) and then select Reference. Then select the field where you want to add this same attribute, and voila.

SharePoint list templates have a locked schema, that is, they only show controls for the columns available on the SharePoint list.
You would need to create a blank, new form template if you wish to have a larger set of controls to work with, and submit to a form library instead of a list.

I imagine that there is still an issue with the /id parameter. That is essentially what allows overwrites.
