Cascading Lists Filter not filtering duplicates

I'm currently working with InfoPath 2003 and I am trying to filter out duplicates in a Cascading list that is receiving data from an XML file which is a secondary source. However, I'm not sure of the syntax.

The secondary data source is setup up as

dataroot
      Departments
            Level1
            Level2

I added the expression filter:

not(. = ../preceding::Departments/@Level1)

The entries field reads:

/dataroot/Departments/Level1[not(. = ../preceding::Departments/@Level1)]

After doing this I still see the duplicates in the menus. I have had no problems setting this up for database and sharepoint secondary lists but can't get it to work in this instance. The syntax was a little different for each so I'm assuming I missing something pretty basic here.
