I am assuming that you are talking about InfoPath libraries in SharePoint?

Yes you can have sub folders, in fact MS recommends using sub folders to manage large libraries.  The Office site has this nice reference you can use:

    http://office.microsoft.com/en-us/sharepointtechnology/HA101736671033.aspx

Technically speaking SharePoint can support millions of items in a list, however, displaying all that data at once is a big performance hit.  At the very least adding some indexed columns to your library and filtering the default view to return a small set of documents is best.

    Hope that helps

I will try this again, But yesterday I published a infopath browser based form to a library then created a sub folder and when publishing another form to the sub folder level. The publishing process defaulted to the top level folder overwriting the top level form.

     Yes, form libraries.

well as i understand your question, you cant publish your form to a sub folder, you can publish your form to a document library and it gets activated for the whole doc library including the sub folders.

you can publish your form as content type and have multiple content types for the same doc library. but that too wont be for individual sub folders
